Terms & Conditions of Hire
Please be aware that these terms and conditions of hire are subject to change closer to the official opening of Market Lane Arts Centre.
(Rooms, Studios, Galleries and Multipurpose Spaces)
These Terms & Conditions apply to all casual and regular bookings at Market Lane Arts Centre. By confirming a booking, the Hirer agrees to these Terms, including the Arts Centre Code of Conduct (Ngā Mātāpono me Ngā Tikanga).
1. Ngā Mātāpono / Code of Conduct (Core Condition of Hire)
1.1 Shared Values
The Arts Centre is a shared creative space committed to creativity, cultural integrity, and inclusive practice. All users must uphold manaakitanga (care), whakaute (respect), kaitiakitanga (care for place), and haumaru (safety).
1.2 Respect for People and Place | He Whakaute mō te Tangata me te Taiao
Discrimination, harassment, bullying, intimidation, or disrespectful behaviour is not tolerated. All staff must be treated respectfully. The wellbeing and safety of all users is a shared responsibility.
1.3 Mana Whenua Tikanga and Kawa | Te Whakaute i te Tikanga me te Kawa
The Art Centre sits within the rohe of Te Āti Awa, Taranaki Whānui, and Ngāti Toa Rangatira. Hirers and participants must behave in ways that uphold mana whenua tikanga, kawa, and cultural safety.
As a minimum expression of respect, users must:
Not sit, stand, lie, or place feet on tables, benches, plinths, tech benches, or work surfaces.
Keep food and drink only in approved areas and never place kai on inappropriate surfaces.
Treat shared taonga (equipment, artworks, furnishings, and fit-out) with care.
Follow any tikanga guidance given by Art Centre staff, including requests for pauses, karakia, or quiet moments where appropriate.
Where tikanga or kawa apply to a specific activity, the Hirer must comply with all reasonable directions from Art Centre staff. The Arts Centre Manager will engage mana whenua as required.
1.4 Shared Use and Collaboration | Te Mahi Tahi
The Art Centre is a shared facility. Users must be mindful of others, shared resources, and noise. Spaces must be left clean, tidy, and reset. Concerns should be raised respectfully with management.
1.5 Professionalism and Responsibility | Te Ngākau Tapatahi me te Haepapa
Users must act professionally and comply with all hire terms, health and safety requirements, and staff directions. Conduct that undermines safety, cultural integrity, or the kaupapa of The Arts Centre may result in loss of access.
1.6 Alcohol, Drugs and Intoxication | Te Haepapa mō te Haumaru
Users must not be intoxicated in a way that compromises safety, disrupts others, or undermines cultural integrity. Management may require any intoxicated person to leave immediately. Serious or repeated incidents may result in suspension or termination of hire.
1.7 Breaches | Ngā Takahitanga
Breaches may be addressed by warnings, mediation, suspension, termination of hire, or future booking restrictions.
2. Bookings, Time and Payment
2.1 A booking is confirmed once accepted by The Art Centre in writing (email confirmation is sufficient).
2.2 The Hire Period must include set-up, pack-down, cleaning, and vacating time.
2.3 Fees are subject to periodic review. The applicable rate is the rate in effect at confirmation.
2.4 Payment is required in advance unless invoicing has been approved.
2.5 Additional charges may apply if the booking runs beyond the agreed time.
3. Changes and Cancellations
3.1 Changes or cancellations require at least 48 hours’ notice.
3.2 Late cancellations or non-attendance may be charged in full.
3.3 Thr Art Centre may alter or cancel bookings where reasonably necessary for safety, civic, operational, or emergency reasons.
3.4 The Art Centre is not liable for losses caused by events beyond its control.
4. Health and Safety
4.1 Hirers must comply with the Health and Safety at Work Act 2015 and all posted procedures.
4.2 Emergency exits and safety equipment must remain clear.
4.3 Hazards, incidents, injuries, or damage must be reported immediately.
4.4 The following require prior written approval: hazardous substances, hot works, smoke/haze, naked flames, messy substances.
5. Use of Spaces and Property
5.1 Spaces may only be used for the approved purpose.
5.2 No fixing, drilling, taping, or alterations without approval.
5.3 Hirers bring equipment at their own risk.
5.4 Hirers are responsible for repair or replacement of any damage caused.
6. Cleaning, Reset and Waste
6.1 Hirers must leave spaces clean, tidy, and reset.
6.2 Excessive cleaning or waste removal may incur additional charges.
6.3 Users are encouraged to support kaitiakitanga by sorting waste appropriately.
7. Noise and Amenity
7.1 Noise must comply with Wellington City regulations and respect neighbours and other users.
8. Food, Alcohol and Animals
8.1 Food and drink only where approved and declared.
8.2 Alcohol only with prior written approval and in accordance with law.
8.3 Animals are not permitted except service animals or by approval.
9. Security and Access
9.1 Doors must not be wedged open or left unsecured.
9.2 Access is limited to booked times and spaces only.
10. Filming, Branding and Promotion
No filming or use of The Art Centre or WCC branding without prior written approval.
11. Legal Compliance
The Art Centre may not be used for any illegal or prohibited purpose.
12. Termination
The Art Centre may terminate a booking immediately for serious misconduct, safety risk, or breach of these Terms or Ngā Mātāpono.
13. Liability
Use is at the Hirer’s own risk to the extent permitted by law. The Hirer indemnifies The Art Centre and WCC except where liability cannot be excluded or is caused by Council negligence.
14. Updates and Governing Law
These Terms may be updated and apply to future bookings. New Zealand law applies.
By confirming a booking, the Hirer agrees to these Terms & Conditions and Ngā Mātāpono me Ngā Tikanga.
Schedule A – Space-Specific Conditions
Studios / Dance Spaces
Clean non-marking footwear, clean socks, or bare feet only.
No sharp objects.
Floors to be swept/cleaned as required.
Gallery / Exhibition Spaces
Installation methods must be approved.
No adhesives or fixings on painted surfaces.
Pack-in/pack-out included in booking time.
Kitchen / Hospitality Areas
Approved use only.
Full clean-down required.
AV / Technical Equipment
Use only as briefed.
Damage or misuse charged.
Dark Room
Prior introductory training required
Use only as briefed.
